SCHR Files Brief in Alabama Supreme Court on Behalf of 13-Year-Old Tasering Victim

Today, SCHR filed a brief in the Alabama Supreme Court on behalf of T.T., a 13-year-old from Mobile, Alabama.  In January 2009, T.T. was tasered by a police officer outside his middle school without provocation or justification.  Following the tasering incident, T.T.’s mother made numerous attempts to obtain records regarding the incident from the City of Mobile. The City declined to produce any records, with the exception of a one-page printout confirming that a taser was, indeed, used on the date and time in question.  In particular, the City refused to produce the report documenting the City’s investigation into the incident.  At issue in this case is whether Alabama law enforcement agencies may, pursuant to Al. Code § 12-21-3.1, forever shield from citizens all law enforcement investigative reports pertaining to citizen complaints of police brutality.  The case is City of Mobile v. Regenia Turner Howard, Supreme Court Case No. 1090941.  Ms. Turner is represented by SCHR attorney Sarah Geraghty and Mobile attorney Henry Brewster.
