Competency

The bulk of litigation over competency has been concerned about the
ability of a defendant to stand trial or to face execution. In most
cases, the right of a capital defendant to be competent during the
direct appeal or post-conviction proceedings has been ignored or
devalued. Insisting on the right of a capital defendant to understand
how and why the state is attempting to kill him not just at trial and
not just at the moment of execution, SCHR attorneys pursue the right of
capital defendants to be competent throughout the entirety of his or
her case.
